Consumers in Poland: the Polish version (Regulamin) governs. This English text is a convenience translation; if the two differ, the Polish text prevails. Everyone else: this English text is the reference version. Where the Polish, Portuguese or Spanish translation differs from it, the English text prevails, unless the mandatory law of the country where you live requires otherwise.
1. Who we are
1.1. Elementals (the "Game") is operated by Krzysztof Gruszczyński, a sole trader registered in Poland, ul. Powstańców Śląskich 176/30, 53-139 Wrocław, Poland, NIP 6351826533, REGON 525095630 (the "Provider", "we", "us").
1.2. You can reach us at support@elementals.pl. We use this address for support, complaints, account matters and all notices under these Terms. You can write to us in English, Polish, Portuguese or Spanish, and we answer in the same language.
1.3. These Terms of Service (the "Terms") are the terms of an electronic service within the meaning of the Polish Act on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną), and form a contract between you (the "User", "you") and the Provider.
2. What the Game is
2.1. Elementals is a free-to-play monster-battling game for Android, distributed through Google Play. You collect, train, breed and battle creatures ("pets").
2.2. The Game is server-authoritative: your progress, items, fights and random outcomes are calculated and stored on our servers, not on your device.
2.3. The Game requires an Account and an internet connection; there is no offline mode. Playing is free. Some optional items can be bought with real money (section 9) and some optional rewards earned by watching ads (section 11).
3. Technical requirements
3.1. To use the Game you need:
- an Android device running Android 7.0 (API level 24) or newer;
- Google Play services installed and working on that device;
- an active internet connection;
- a valid email address, or a Google Play Games profile if you sign in with Google Play Games.
3.2. Data transmission may cost you money under your contract with your mobile operator or internet provider. Those costs are yours. We do not guarantee that the Game works on rooted, modified or emulated devices, or on unofficial builds of Android.
4. Your Account
4.1. To play you must create an Account — either with an email address and a password, or through Google Play Games sign-in.
4.2. When you register you confirm that you have read and accept these Terms and the Privacy Policy. Registration is the moment the contract between you and us is concluded. It runs for an indefinite period and you may end it at any time by deleting your Account (section 7).
4.3. Minimum age is 13. If you are between 13 and 17, you may use the Game only with the consent of your parent or legal guardian, who is responsible for your use of the Game and for any purchases made through your Account. We may ask for confirmation of that consent.
4.4. One Account per person. You may not create multiple Accounts, share your Account with anyone, or sell, rent, buy or transfer an Account.
4.5. You are responsible for keeping your password confidential and for everything that happens on your Account. Tell us at support@elementals.pl immediately if you think someone else has access to it.
5. Rules of conduct
5.1. When using the Game you must not:
- cheat, or use bots, macros, scripts or any automation to play for you;
- exploit bugs, glitches or errors instead of reporting them to us;
- modify, reverse-engineer, decompile or repackage the app, or interfere with the communication between the app and our servers;
- use multiple Accounts to gain an advantage;
- harass, threaten, insult or discriminate against other players;
- impersonate another person, the Provider, or a member of our support team;
- choose usernames or pet nicknames that are offensive, vulgar, hateful, sexual, deceptive, or that infringe someone else's rights;
- attempt to overload, attack, or gain unauthorised access to our servers;
- sell, trade or advertise the sale of Accounts or Virtual Items for real money outside the Game;
- use the Game in a way that breaks the law or these Terms.
5.2. You are welcome — encouraged, in fact — to report bugs and exploits to support@elementals.pl.
6. Suspension and termination by us
6.1. If you break these Terms we may, in proportion to the breach: issue a warning; remove or correct Virtual Items or game state obtained in breach; temporarily suspend your Account; or permanently terminate it.
6.2. Where feasible and lawful, we will tell you by email what measure we took and why, before or immediately after it takes effect.
6.3. You may appeal by writing to support@elementals.pl within 30 days. We will consider the appeal and reply within 14 days. If it succeeds, we restore the Account and, where possible, the affected game state.
6.4. We may also terminate the contract with 14 days' notice if we discontinue the Game (section 13.6).
7. Ending the contract yourself
7.1. You may stop using the Game and delete your Account at any time, with no notice period and at no cost:
- in the app: Profile → PRIVACY & DATA → DELETE ACCOUNT; or
- by email to support@elementals.pl.
7.2. Deleting your Account removes or anonymises your personal data as described in the Privacy Policy, and ends your access to all Virtual Items. Deleting an Account is not a refund and does not create a right to compensation for unused Virtual Items.
7.3. Accounts inactive for 730 days may be anonymised. Before we do that we will send a warning to the email address on the Account.
8. Virtual Items
8.1. "Virtual Items" means coins, pets, breeding stations, lock tokens and any other in-game item, currency, resource or progress.
8.2. Virtual Items are not your property. We grant you a limited, personal, revocable, non-transferable, non-sublicensable licence to use them inside the Game, for as long as your Account and the Game exist.
8.3. Virtual Items:
- have no real-world value;
- cannot be exchanged for money, other goods, or anything of value outside the Game;
- cannot be transferred to another Account, sold or traded outside the Game;
- are not a means of payment, electronic money, a financial instrument or a deposit.
8.4. We may add, change, rebalance, re-price or remove Virtual Items, and change how they behave, for reasons of game balance, technical necessity, law or security. Balance changes are a normal part of a live game.
8.5. We may revoke Virtual Items obtained through a bug, an exploit, a refunded or charged-back purchase, or a breach of section 5.
9. Purchases
9.1. All paid purchases in the Game are made through Google Play. We do not take payments directly and we never ask you for card details.
9.2. Purchasable content currently includes coin packs, the breeding station, and instant completion of breeding. The catalogue may change.
9.3. Prices are the ones shown in Google Play at the moment of purchase and include VAT. Google Play shows the final price in your currency before you confirm.
9.4. The contract for a purchase is concluded when Google Play confirms the transaction. Delivery is immediate: the Virtual Item is credited to your Account as soon as our server verifies the purchase with Google, normally within seconds. If it has not appeared within 24 hours, contact support@elementals.pl.
9.5. Payment methods, invoices, taxes and Google's own refund handling are governed by your relationship with Google, under Google Play's Terms of Service.
9.6. Refunds are handled through the Google Play refund process — in the Google Play app or in your order history. You may also write to support@elementals.pl and we will help where we can. If a purchase is refunded or charged back, we may remove the corresponding Virtual Items and anything bought with them, and may suspend an Account used to abuse refunds.
9.7. Your statutory rights as a consumer, including rights where digital content does not conform to the contract, are not affected by this section.
10. Right of withdrawal (EU consumers)
10.1. As a consumer you normally have 14 days to withdraw from a distance contract without giving a reason.
10.2. Purchases in the Game are digital content delivered immediately and not on a tangible medium. Purchases are made through the Google Play checkout, and the purchase terms shown there — including Google Play's own refund and withdrawal rules — apply to the transaction (see section 9). The Game itself does not ask you to waive the right of withdrawal, and we do not rely on such a waiver given inside the Game. Nothing in these Terms limits any right you have by law as a consumer, including the right of withdrawal under the Polish Act on Consumer Rights (ustawa o prawach konsumenta) and Directive 2011/83/EU, to the extent it applies to your purchase. If you believe you are entitled to withdraw from a purchase, write to support@elementals.pl or request a refund through Google Play, and we will handle it in accordance with the law.
10.3. The free contract itself (your Account, section 4) may be withdrawn from within 14 days of registration, by an unequivocal statement to support@elementals.pl or simply by deleting your Account.
10.4. Users outside the EU: see section 21.
11. Rewarded ads
11.1. The Game may offer rewarded ads: you watch a short video and receive an in-game reward.
11.2. Watching ads is entirely optional and always begins with an explicit action by you. We never require you to watch an ad in order to keep playing.
11.3. Rewards are granted only after our server confirms with the ad provider that the ad was genuinely watched. Daily limits may apply. Faking ad completion is a breach of section 5.
12. Randomised outcomes
12.1. Some actions in the Game have random outcomes decided by the server. The main one is breeding: two pets produce an offspring whose rarity is determined by a random roll.
12.2. The probabilities are shown in the Game before you confirm the action. For reference, at the time of publication:
- when a breeding recipe matches: Rare 80%, Epic 10%, Legendary 1%;
- otherwise, the offspring's rarity follows the parents' species weights.
12.3. The authoritative, up-to-date probability table is the odds panel on the
breeding screen in the Game. The same figures are published, without signing
in, by the server at GET /api/content/breeding-odds (on the Game's API host,
https://api.elementals.pl). The figures in 12.2 are a
snapshot and may be adjusted for balance; the in-game table always governs.
12.4. Random rolls are performed and recorded server-side. We do not change the odds for individual players, and outcomes do not depend on how much you have spent.
12.5. No purchase is required to obtain a randomised outcome: breeding can be performed with in-game coins earned through ordinary play.
13. Availability of the Game
13.1. We aim to keep the Game available continuously, but we do not guarantee uninterrupted or error-free service. The Game depends on our servers, Google Play services, your device and your internet connection.
13.2. We may carry out maintenance, including planned downtime, and will try to announce significant planned interruptions in the app in advance.
13.3. We may add, change, restrict or remove features, content, zones, species, skills and balance values, in order to develop the Game, fix problems, comply with the law, or keep the Game secure and sustainable.
13.4. We may require you to install an update of the app. Older versions may stop working with our servers.
13.5. Because the Game is server-authoritative, we may correct or reset game state — including Virtual Items, levels and progress — where that is necessary to fix a bug, reverse the effects of an exploit, or restore data after a technical failure. We will keep such corrections to the minimum needed.
13.6. We may discontinue the Game. If we do, we will give at least 30 days' notice in the app or by email, stop selling Virtual Items from the day of the announcement, and deal in good faith with refund requests sent to support@elementals.pl for purchases made shortly before it that you could not reasonably use.
14. Intellectual property
14.1. The Game and everything in it — software, artwork, character and species designs, music and sound, text, the name "Elementals" and our logos — is owned by the Provider or licensed to us, and protected by copyright and other laws.
14.2. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you control, for your own non-commercial entertainment, for as long as your Account exists.
14.3. Except where mandatory law allows it, you may not copy, distribute, publicly perform, modify, create derivative works from, or commercially exploit the Game or its assets. Recording and streaming your own gameplay, including monetising such videos on ordinary platform terms, is permitted.
15. Content you provide
15.1. You provide some content yourself: your username, your pets' nicknames, and anything you write to us.
15.2. You must have the right to use that content, and it must comply with section 5.1(7). We may change or remove a username or nickname that breaches these Terms, and we will tell you when we do.
15.3. By providing such content you grant us a free, non-exclusive, worldwide licence to store, display and process it as needed to run the Game — for example to show your name to an opponent, in fight logs and in leaderboards. It ends when the content or your Account is deleted.
16. Personal data
16.1. How we collect and use personal data is described in the Privacy Policy, which forms part of your relationship with us.
16.2. In short: we process your email address or Google Play Games player ID for authentication, your game state to run the Game, and crash and analytics data to fix and improve it. You may request an export of your data, or delete your Account (section 7).
17. Complaints
17.1. Send complaints — about the Game, a purchase, a measure taken against your Account, or anything else — to support@elementals.pl.
17.2. Please include your Account email or username, a description of the problem, when it happened, and what you would like us to do. We will reply within 14 days, to the address you wrote from.
17.3. If we do not resolve the matter, a consumer may use out-of-court dispute resolution:
- if you live in another EU country: the European Consumer Centre of your country (ECC-Net), which helps consumers with cross-border disputes: https://commission.europa.eu/live-work-travel-eu/consumer-rights-and-complaints/resolve-your-consumer-complaint/european-consumer-centres-network-ecc-net_en;
- in Poland: the Wojewódzki Inspektorat Inspekcji Handlowej (permanent consumer arbitration courts and mediation), the municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów), or a consumer organisation. General information is available from UOKiK at https://www.uokik.gov.pl.
17.4. Out-of-court resolution is voluntary for both sides and does not take away your right to go to court.
18. Liability
18.1. We are liable for damage caused by failing to perform, or improperly performing, our obligations under these Terms, on the general terms of the Polish Civil Code.
18.2. To the extent permitted by law, we are not liable for: loss caused by your own breach of these Terms; problems caused by your device, your internet connection or third-party services such as Google Play; or loss of Virtual Items or progress caused by circumstances outside our reasonable control.
18.3. Nothing in these Terms excludes or limits our liability for intentional harm, for death or personal injury, or any other liability that cannot be excluded or limited under applicable law.
18.4. Nothing in these Terms limits the rights you have as a consumer under Polish or EU law, or the mandatory law of the country where you live. If any clause conflicts with those rights, the mandatory legal rule applies and the rest of the Terms remain in force.
18.5. Towards Users who are not consumers, our total liability is limited to the amount that User paid us in the 12 months before the event, and we are not liable for lost profits.
19. Changes to these Terms
19.1. We may change these Terms for a valid reason — a change in the law, a decision of a public authority, a change in the Game's features or payment methods, security, or correcting an error.
19.2. We will announce material changes at least 14 days in advance, in the app or by email to the address on your Account, together with the new text and the date it takes effect.
19.3. If you keep using the Game after the change takes effect, the new Terms apply to you. If you do not accept them, you may terminate the contract at any time, at no cost, by deleting your Account (section 7).
19.4. Changes never apply retroactively to purchases already made.
20. Governing law and final provisions
20.1. These Terms and the contract between us are governed by Polish law. This choice does not deprive a consumer of the protection of the mandatory rules of the law of their country of habitual residence.
20.2. Disputes with a consumer are heard by the courts having jurisdiction under statutory rules. Disputes with a User who is not a consumer are heard by the court having jurisdiction over the Provider's registered address.
20.3. If any provision of these Terms is found invalid, the remaining provisions stay in force.
20.4. The Polish version of these Terms (Regulamin) is the governing version for consumers resident in Poland. For everyone else, this English text is the reference version: where the Polish, Portuguese (Termos de Serviço) or Spanish (Términos de servicio) translation differs from it, the English text prevails, unless the mandatory law of the country where you live requires otherwise.
20.5. These Terms are available free of charge at https://elementals.pl/terms, in a form that allows you to download, save and print them.
21. Users outside the European Union
21.1. Wherever you live, the mandatory consumer-protection law of your country of residence applies to you whatever these Terms say (sections 18.4 and 20.1). Nothing in these Terms takes away a right that law gives you.
21.2. Brazil. As a consumer you have the right of regret (direito de arrependimento) under art. 49 of the Código de Defesa do Consumidor (Lei nº 8.078/1990): 7 days from the purchase, to the extent it applies to your purchase. To use it, write to support@elementals.pl or request a refund through Google Play (section 9.6). The identification of the Provider required by art. 2 of Decreto nº 7.962/2013 — name, registration numbers, postal and e-mail address — is in section 1.
21.3. Spanish-speaking Latin America. The law of your country may give you a right to revoke or withdraw from a distance purchase — for example art. 56 of Mexico's Ley Federal de Protección al Consumidor (5 business days), art. 34 of Argentina's Ley 24.240 (10 days) and art. 47 of Colombia's Ley 1480 de 2011 (5 business days) — to the extent it applies to your purchase. You exercise it the same way: write to support@elementals.pl or request a refund through Google Play.
21.4. Complaints outside the EU. If we do not resolve a complaint (section 17), you may turn to the consumer authority of your country — for example the PROCON of your state in Brazil, PROFECO (Procuraduría Federal del Consumidor, https://www.profeco.gob.mx/) in Mexico, Defensa del Consumidor (Secretaría de Industria y Comercio, https://www.argentina.gob.ar/produccion/defensadelconsumidor) in Argentina, or the Superintendencia de Industria y Comercio (SIC, https://www.sic.gov.co/) in Colombia.
